FTC "RED FLAGS" Rule -  for more info, click here Medical News

On August 1st, most health care providers must comply with the “Red Flags” rule, a requirement authorized by Congress as part of the Fair and Accurate Credit Transaction Act of 2003.  The legislation requires various federal agencies to adopt regulations requiring financial institutions or creditors to develop and implement a written identity-theft prevention program.  The government released the final Red Flags regulations set for enforcement, Nov. 1, 2008.  In summer of 2008 the AMA, MGMA and others in the healthcare community learned that the FTC?interpreted the rule to apply to health care providers, considering them “creditors”.  Although much advocacy against this interpretation has been made, the ruling stands and the deadline has only been extended now to August 1, 2009.

The federal government’s decision to spend $19 billion on Health Information Technology has created a flurry of information and misinformation. Your state and component medical societies are working together to help you make the best decisions for your practice.
